Terms of Service

By accessing or using the Skate Bounty mobile application and related services (collectively, the "Service"), you agree to be legally bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must immediately stop using the Service. Your continued use of the Service after any changes to these Terms constitutes acceptance of those changes.

You must be at least 18 years of age to create an account or use the Service. We ask for your date of birth at signup and will refuse registration to anyone under 18. The Service is not directed to children, and we do not knowingly collect information from anyone under 18. By using the Service, you represent and warrant that you are at least 18 years old and that your use of the Service does not violate any applicable law or regulation.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and current information during registration and to keep your account information updated. You must notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate any account at our sole discretion.

SKATEBOARDING, INLINE SKATING, BMX RIDING, SCOOTERING, AND ALL RELATED ACTIVITIES ("SKATING ACTIVITIES") INVOLVE SERIOUS RISK OF BODILY INJURY OR DEATH. By using the Service to discover, post, or participate in bounties involving Skating Activities, you expressly acknowledge and assume all risks associated with those activities, including but not limited to: falls, collisions with other persons or objects, use of ramps or street obstacles, varying surface conditions, and equipment failure.

ALL SKATING ACTIVITIES ARE COMPLETED ENTIRELY AT YOUR OWN RISK. Skate Bounty LLC and its officers, employees, agents, and affiliates (collectively, "Skate Bounty") are NOT responsible for any injury, disability, death, property damage, damage to third-party property, or any other loss or harm that you or any third party may suffer as a result of participating in or observing any Skating Activity facilitated, suggested, or promoted through the Service. This includes, without limitation, any damage to public or private property caused while attempting a trick or navigating a skate spot.

You participate in all such activities entirely at your own risk. You are solely responsible for any damage you cause to property, whether public or private, in connection with any Skating Activity. You are strongly encouraged to wear appropriate protective equipment including but not limited to helmets, knee pads, elbow pads, and wrist guards at all times.

Skate Bounty provides tools to post and discover skate spots, but we do not own, operate, inspect, or maintain any physical location listed on the Service. We make no representations regarding the safety, legality, accessibility, or suitability of any skate spot. You are solely responsible for determining whether skating at a particular location is legal, safe, and appropriate. Always obtain any required permits or permissions from property owners or local authorities before skating at any location.

A bounty is a reward a user offers for landing a specific trick at a specific spot. The poster funds the reward in full before the bounty goes live. Skaters never pay anything to submit a clip.

How a bounty is paid: the poster reviews submitted clips in the order they arrived and approves or rejects each one on whether it lands the trick as described. The first clip the poster approves is paid the full reward, the bounty closes, and any other clips still waiting are declined. If clips are still waiting 24 hours after the bounty ends, the earliest clip that has not been flagged (for example, because its recording date or location does not match the bounty, or because it has been reported) is approved and paid automatically. Community votes on clips do not affect who is paid. If no clip is paid, the reward is refunded to whoever funded it.

We do not verify that any trick is safe to attempt, appropriate for your skill level, or legally permitted at the relevant location. You acknowledge that attempting any trick in response to a bounty is done voluntarily and entirely at your own risk. Bounty posters are solely responsible for the accuracy and legality of the bounties they post.

Bounties are funded in cash via Stripe. Payment processing is handled by Stripe, Inc. and is subject to Stripe's own terms of service. Skate Bounty is not a bank or payment institution and does not hold your funds on deposit. You must be at least 18 years of age to set up a payout account and receive bounty payments. Bounty payouts are made to your Stripe Connect payout account, are subject to our claims review process, and we reserve the right to withhold payment pending investigation of any disputed claim. We are not liable for any payment processing errors, delays, or failures caused by Stripe or other third-party payment providers.

All transactions are final unless otherwise required by applicable law.

By submitting content to the Service (including photos, videos, descriptions, claim submissions, and Instagram links), you grant Skate Bounty a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, display, and distribute that content in connection with operating and promoting the Service. You represent and warrant that you own or have all necessary rights to the content you submit, and that your content does not infringe any third-party intellectual property rights. You are solely responsible for your content. We reserve the right to remove any content at our discretion.

You agree not to: (a) post bounties that encourage illegal activity or trespassing; (b) submit false, fraudulent, or misleading claims; (c) harass, threaten, or harm other users; (d) attempt to manipulate or game the bounty system; (e) use the Service to distribute spam or malicious software; (f) reverse-engineer, scrape, or data-mine the Service; (g) impersonate any person or entity; (h) post content involving minors in potentially dangerous activities; or (i) violate any applicable local, state, national, or international law.

Zero tolerance. There is no tolerance on Skate Bounty for objectionable content or abusive users. Objectionable content includes harassment, bullying, threats, hate speech, sexual or sexually explicit content, violence against people, and any content involving minors. You can report any spot, bounty, clip, or user from within the app, and you can block any other user so you no longer see their content. We review reported content within 24 hours. A clip that has been reported is hidden from other users while we review it. Content that violates these Terms is removed, and the accounts of users who post it or behave abusively are suspended or permanently terminated.

The Service integrates with or links to third-party services including Instagram, Google Maps, and Stripe. Skate Bounty has no control over and assumes no responsibility for the content, policies, or practices of any third-party services. Your use of those services is governed by their respective terms and privacy policies. The inclusion of any third-party link or integration does not imply endorsement by Skate Bounty.

All trademarks, service marks, logos, and content created by Skate Bounty (excluding user-submitted content) are the exclusive property of Skate Bounty LLC. You may not use, reproduce, or distribute any Skate Bounty intellectual property without our prior written consent. Nothing in these Terms grants you any license to Skate Bounty's intellectual property other than the limited right to use the Service as described herein.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SKATE BOUNTY DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SKATE BOUNTY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, PROPERTY DAMAGE, LOSS OF PROFITS, LOSS OF DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE OR ANY CONTENT THEREON, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT WILL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO SKATE BOUNTY IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).

You agree to indemnify, defend, and hold harmless Skate Bounty and its officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your violation of these Terms; (b) your use of the Service; (c) your participation in any Skating Activity; (d) any content you submit; or (e) your violation of any law or the rights of a third party.

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Service shall first be addressed through good-faith negotiation. If unresolved, disputes shall be settled by binding arbitration under the American Arbitration Association's Consumer Arbitration Rules, conducted in San Francisco, California. You waive any right to participate in a class action lawsuit or class-wide arbitration.

We may suspend or terminate your account and access to the Service at any time, for any reason, with or without notice. Upon termination, all rights granted to you under these Terms will immediately cease. Sections 4, 12, 13, 14, 15, and all other sections that by their nature should survive, will survive termination.

We reserve the right to modify these Terms at any time. We will notify you of material changes through the app or by email. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service.
